The Department of Justice has convened a grand jury to investigate New York Attorney General Letitia James, marking a significant development in the ongoing legal battles between President Donald Trump and the state’s top prosecutor.

According to two sources familiar with the matter, the investigation is based in Albany and is examining possible deprivation of rights allegations. The probe is still in its early stages, but James’s office has reportedly received subpoenas for documents this week, including materials connected to her civil fraud lawsuit against Trump.

James, a Democrat elected in 2018, has been one of Trump’s most persistent legal adversaries. In 2022, she brought civil fraud charges against him, ultimately securing a $454 million judgment against the former president and several executives at the Trump Organization, including two of his sons. A New York judge concluded that Trump and his associates had significantly overstated his wealth to secure favorable loans and other benefits. At the time, James stated that financial fraud was not a “victimless crime” and should be prosecuted equally, regardless of a person’s status.

A spokesperson for James said the DOJ’s action represented a troubling misuse of prosecutorial authority. “Any weaponization of the justice system should disturb every American,” the spokesperson said. “We stand strongly behind our successful litigation against the Trump Organization and the National Rifle Association, and we will continue to stand up for New Yorkers’ rights.”

The DOJ declined to comment.

James has also been active in challenging the Trump administration’s policies in court, joining other Democratic attorneys general in lawsuits over spending freezes on federally funded social programs, the dismissal of federal employees, and restrictions on transgender care for minors.

The formation of a grand jury is the first step toward a possible indictment. The panel will review evidence and interview witnesses to determine whether probable cause exists to bring charges. While obtaining an indictment from a grand jury is generally easier than securing a conviction, the process can still take weeks or longer.

This latest DOJ investigation follows another inquiry announced in April, when the Trump Federal Housing Finance Agency requested that Florida Attorney General Pam Bondi look into allegations of mortgage fraud involving James. The DOJ also opened a separate investigation into that matter, and James was subpoenaed as part of the probe. She has denied the mortgage fraud allegations.

In response to the earlier investigation, Trump called James a “wacky crook” on Truth Social, adding, “Letitia James, a totally corrupt politician, should resign from her position as New York State Attorney General, IMMEDIATELY.”

Tensions between Trump and James remain high, with the new federal investigation adding to the already long list of legal disputes between them.
